Testifying for the State on the fourth day of trial, the Creative Preschool employee described the daycare on West Tharpe Street in Tallahassee where Dan Markel's children were enrolled and where Markel typically came inside on days he made the drop-off. On direct examination he placed Markel at the school between roughly 9:45 and 10:00 a.m. on July 18, 2014, entering through a side gate while children finished breakfast outdoors. Alerted by the sound of a door opening, he looked outside and observed a small car he believed to be a Prius parked directly in front of the main building and facing Tharpe Street. He described the color as shifting between grayish-green and silver depending on the light. He could not say whether the car remained for the entire time Markel was on the grounds, and noted it was gone when he next looked. Two photographs of the preschool exterior were authenticated as fair and accurate depictions of the property as it appeared that day and were admitted without objection noted on the record.
Counsel for Sigfredo Garcia conducted a brief cross-examination that used the admitted exhibit to establish the layout of the parking areas and then narrowed the scope of the observation. The witness acknowledged that he could not see inside the Prius because the rear window was tinted and the car faced away toward Tharpe Street, and he confirmed that he never saw anyone get out of the vehicle. Asked whether he recalled Markel dropping the children off on June 5th, he answered that he could not honestly remember. Co-counsel for Katherine Magbanua followed with a short cross-examination confined to the school's record-keeping: the witness confirmed that daily logs recorded the date, time, and name of the adult who dropped off or picked up each child, that signing in and out was standard practice required by law though parents sometimes missed it, that records were retained for up to a year, and that those procedures were in place in 2014.
Juror questions followed the crosses. Asked whether the Prius had been on preschool property or on the street, the witness placed the vehicle in a preschool parking spot rather than a street position. The jury-question phase also established that his specific recollection of the green Prius was not conveyed to investigators until around 2016; the initial 2014 police contact concerned child welfare and did not surface the vehicle.
Throughout, the witness qualified his uncertain recollections rather than filling gaps — he did not fix the car's exact parking spot, did not claim it stayed the whole visit, and characterized Markel's drop-off habit as typical rather than invariable. His testimony records a civilian sighting of a grayish-green or silver Prius at the daycare while Markel was present. He did not see or identify an occupant, leaving any connection to other Prius evidence to be established elsewhere in the record. His observation was later referenced in testimony about what law enforcement knew of a daycare witness who had seen a green Prius.
