Called by the State on the first day of testimony as the director of Premier Health and Fitness Center, a position held for 33 years, Harvey described the gym's camera system: ten exterior and six interior cameras recording continuously to a hard drive in his office, with footage retained roughly 30 days. He confirmed the system was operational in July 2014 and authenticated a disc of footage captured on July 18, 2014, admitted as State's Exhibit 124 without objection from either defense team. Georgia Cappleman reserved publication of the video; neither Garcia's nor Magbanua's counsel cross-examined, and no juror questions followed that appearance.
The State recalled Harvey on the third day of testimony, still under oath, to introduce State's Exhibit 177 — a thumb drive containing the full, unedited surveillance footage from which the previously admitted clips had been drawn. He confirmed the footage was fair and accurate and that no editing had been performed, and estimated the complete recording ran several hours. Saam Zangeneh sought clarification on whether the exhibit was new evidence or material edited for presentation; after a sidebar he withdrew any objection and the exhibit was admitted. Cappleman then published a brief segment so jurors could compare the clips in the earlier exhibit against the complete record, noting that all camera angles covering the period Dan Markel was present at the gym were available.
On cross-examination, Zangeneh probed the limits of Harvey's own review of the recordings. Harvey estimated he had watched approximately 75 percent of the available footage, having skipped angles with poor image quality or views showing only trees, and he described areas of the property that fell outside camera coverage. He agreed the parking lot was busy and fluid on the morning of the murder. Asked whether he had seen anyone exit the Prius to urinate, Harvey answered that he did not recall seeing it and agreed he likely would have noticed and reported such footage had it existed on the recordings he reviewed; asked specifically about Sigfredo Garcia, he answered no. Magbanua's counsel and the State asked no further questions, so the examination closed without redirect or recross.
Juror questions followed. Harvey explained that the cameras in the newly admitted exhibit are identified both by number, one through sixteen, and by descriptive location — south parking lot, west, northwest, and north parking — giving jurors a framework for navigating the multi-feed exhibit. He also clarified that real-time monitoring occurs only at a screen in his office and that on-ground response depends on a single foot-patrol facilities manager in standard employee uniform rather than a dedicated security team, and he described the layout of the business and its surroundings before being excused.
