About

In Garcia and Magbanua's 2019 joint trial, Stewart Schlazer testified on Day 1 about a July 18, 2014 phone call with Dan Markel. He said Markel reported that an unfamiliar person was in the driveway.

Schlazer testified that he then heard a loud sound and Markel breathing. When Markel did not answer his questions, Schlazer called 911.

On cross-examination, defense counsel questioned whether Markel had referred to one unfamiliar person or multiple people. Schlazer said the word “unfamiliar” stood out in his memory, but he could not recall the exact singular or plural form after five years and believed his earlier sworn statement used the singular.
