State Rests
24 linesMS. CAPPLEMAN: Judge, with that, the State rests.
JUDGE EVERETT: Very well. Well, members of the jury, we are going to take our break in the trial at this point for the weekend.
JUDGE EVERETT: Once again, I'm going to remind you not to discuss this case with each other or any other person. You are also not to seek out any outside information or news reporting on this matter as well. We will resume with the trial on Tuesday morning after the Labor Day holiday. Please report at 8:30 and we will try to get started by 8:45 on Tuesday.
JUDGE EVERETT: Enjoy your holiday weekend. I think football is back.
JUDGE EVERETT: If you have something to watch that does not concern this trial, have a good weekend.
JUDGE EVERETT: 8:30 on Tuesday. Tuesday.
JUDGE EVERETT: Tuesday, not Monday.
JUDGE EVERETT: Let nobody be here on Monday.
JUDGE EVERETT: Everyone can be seated.
JUDGE EVERETT: Does the defense have any motions to raise at this point in the trial?
MR. ZELMAN: Your Honor, I thought — my understanding was that we were going to do that Tuesday morning.
JUDGE EVERETT: Well, that's if the State had rested its case as of Tuesday morning.
MR. ZELMAN: I request to reserve until Tuesday morning so that I can organize my thoughts.
JUDGE EVERETT: Very well.
MR. ZELMAN: Thank you, Your Honor.
JUDGE EVERETT: All mid-trial motions will need to be addressed on Tuesday morning before we get started with the jurors. With the State having rested its case at this point, the defense needs to make all necessary arrangements for the defense case-in-chief and all witnesses that will be called.
JUDGE EVERETT: Concerning the defense case-in-chief, how many days do you think it will take starting Tuesday morning?
MR. ZELMAN: Can we let you know Tuesday morning, Your Honor?
JUDGE EVERETT: I believe you know who you intend to call, but we can discuss it Tuesday morning.
JUDGE EVERETT: Does either party have anything to raise before we go to the break for the weekend? Thanks. For the State?
MR. ZELMAN: Thank you, Your Honor.
MS. CAPPLEMAN: Nothing from the State.
MR. ZELMAN: Not at this time, Your Honor.
JUDGE EVERETT: Have a good weekend, everyone. Please report by 8:30 as well on Tuesday. If the gallery can remain in the courtroom for right now.
