150 linesJUDGE EVERETT: Everyone but the witness may be seated.
JUDGE EVERETT: Please raise your right hand, ma'am.
JUDGE EVERETT: Do you swear or affirm the testimony you're about to give will be the truth?
CLARIZA LEBREDO: I do.
JUDGE EVERETT: You may take your seat.
MS. DUGAN: Please speak loudly and clearly.
MS. DUGAN: Good morning.
CLARIZA LEBREDO: Good morning.
MS. DUGAN: Will you tell us your name and spell it for our court reporter, please?
CLARIZA LEBREDO: Clariza. C-L-A-R-I-Z-A.
CLARIZA LEBREDO: Lebredo. L-E-B-R-E-D-O.
MS. DUGAN: And did you work at the Adelson Institute for a number of years?
CLARIZA LEBREDO: Yes.
MS. DUGAN: About how many years did you work there?
CLARIZA LEBREDO: Almost 40 years.
MS. DUGAN: Okay. And was the Adelson Institute sold about two years ago to another dental practice?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And do you still work at that dental practice that they were sold to?
CLARIZA LEBREDO: Yes.
MS. DUGAN: All right. Where was the Adelson Institute located?
CLARIZA LEBREDO: In Tamarac.
MS. DUGAN: Tamarac. About how far is that from Miami?
CLARIZA LEBREDO: Miami? About 30 miles.
MS. DUGAN: And is the exact address 7737 University Drive in Tamarac?
CLARIZA LEBREDO: Yes.
MS. DUGAN: All right. The Adelson Institute's a dental — was a dental office, right?
CLARIZA LEBREDO: Dental office, yes.
MS. DUGAN: Okay. The questions I'm going to ask you about the Adelson Institute are about the years from 2013 to 2016, okay?
CLARIZA LEBREDO: Okay.
MS. DUGAN: What was your position at the Adelson Institute during that time?
CLARIZA LEBREDO: Dental assistant.
MS. DUGAN: Okay. And did you ever work the front desk?
CLARIZA LEBREDO: No.
MS. DUGAN: And do you know Dr. Harvey Adelson?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And did you know his wife, Donna Adelson?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Did both of them work there during 2013 to 2016?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Okay. And what was Dr.
MS. DUGAN: Harvey Adelson's job at the Adelson Institute?
CLARIZA LEBREDO: He was the dentist.
MS. DUGAN: Okay. And was there another dentist that worked there as well?
CLARIZA LEBREDO: Charlie worked there too.
MS. DUGAN: Okay, Charlie Adelson?
CLARIZA LEBREDO: Yes, Charlie Adelson.
MS. DUGAN: All right, and what was Donna Adelson's role at the Adelson Institute?
CLARIZA LEBREDO: Donna was our office manager.
MS. DUGAN: Okay, and how long have you known the Adelson family?
CLARIZA LEBREDO: 40 years, over 40 years.
MS. DUGAN: So ever since you began working there, it was Adelson Institute even back then?
CLARIZA LEBREDO: The name changed, but it was always a dental practice.
MS. DUGAN: Okay. And you've known their family for 40 years.
CLARIZA LEBREDO: Yes.
MS. DUGAN: All right. In addition to Harvey Adelson, Donna Adelson, and Charlie Adelson, back from 2013 to 2016, I want to ask you about the other people that worked there.
MS. DUGAN: What about Erika Johnson? Did she work there during those years?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And was there also a hygienist?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And was her name Amy?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Okay. And was that all of the office staff?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Okay, so Donna Adelson, Harvey Adelson, Charlie Adelson, you, Erika Johnson, and Amy the hygienist.
CLARIZA LEBREDO: Correct.
MS. DUGAN: Those were the employees of the Adelson Institute during those years?
CLARIZA LEBREDO: Yes.
MS. DUGAN: What were the Adelson Institute business hours during that time?
CLARIZA LEBREDO: Hmm, nine to five, and we had a late night.
MS. DUGAN: Okay. Was it nine to five only three days a week?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Was that Monday, Tuesday, and Thursday were the nine-to-five hours?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Was Wednesday the late-night hour?
CLARIZA LEBREDO: Late night was Wednesday, 11 to 7.
MS. DUGAN: 11 to 7. Okay, I guess to try to accommodate the people that had a hard time coming during regular business hours, right?
CLARIZA LEBREDO: Yes.
MS. DUGAN: All right. And did — did the doctors routinely see patients on Fridays or on the weekends?
CLARIZA LEBREDO: Emergencies only.
MS. DUGAN: Okay. So that wasn't a routine thing for them to do.
MS. DUGAN: And Adelson Institute did not have operating hours on Friday or the weekends, correct?
CLARIZA LEBREDO: No.
MS. DUGAN: Now, back during those years, if a patient called Adelson Institute on a Friday or on a weekend, would it be routed to voicemail?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And when y'all came in on Monday morning, would somebody check that answering machine to return the calls of patients?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Who had access to employee records?
CLARIZA LEBREDO: The Adelsons.
MS. DUGAN: Okay, so that's not something you would have access to? And when you say the Adelsons, you mean the Adelsons — Donna and Dr. Adelson?
CLARIZA LEBREDO: Donna and Dr. Adelson.
MS. DUGAN: Okay, thank you.
MS. DUGAN: Do you remember two law enforcement officers coming to Adelson Institute back on June 1st of 2016 at about 11 a.m.?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And did they ask you if you were familiar with an employee named Katherine Magbanua?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Who did you — are you familiar with an employee named Katherine — I'm — I'm sorry, with a person named Katherine Magbanua?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Okay, and how do you know Katherine Magbanua?
CLARIZA LEBREDO: From the office.
MS. DUGAN: Okay, from being a patient at the office or being an employee at the office?
CLARIZA LEBREDO: No, a patient.
MS. DUGAN: Patient.
MS. DUGAN: And about how many times did you see her there as a patient?
CLARIZA LEBREDO: I believe two or three times.
MS. DUGAN: Okay, did you provide testimony in another proceeding for a co-defendant's case back in May of 2022?
MS. DUGAN: Did you provide testimony in another proceeding in a co-defendant's case back in May of 2022?
CLARIZA LEBREDO: Yes.
MS. DUGAN: Okay, and I'm going to show you your prior testimony. I'm looking at page 1226, lines 6 and 7.
MS. DUGAN: I know it's been quite a while.
MS. DUGAN: Looking at those lines, when you were asked how many times had she been a patient, did you say once?
CLARIZA LEBREDO: I said once that day, yes.
MS. DUGAN: In your 40 years with the Adelson Institute, had you ever seen Katherine Magbanua at Adelson Institute as anything other than a patient?
CLARIZA LEBREDO: No.
MS. DUGAN: When investigators asked you about Katherine Magbanua that day, if you were familiar with her as being an employee there and you said no, who did you refer them to? Which employee at Adelson Institute?
CLARIZA LEBREDO: Erika.
MS. DUGAN: Erika was kind of working front desk at that time?
CLARIZA LEBREDO: Yes.
MS. DUGAN: All right, and then from there on Erika spoke to the investigators?
CLARIZA LEBREDO: Yes.
MS. DUGAN: How did you get paid by Adelson Institute?
CLARIZA LEBREDO: With checks.
MS. DUGAN: And about how often would you get checks from them?
CLARIZA LEBREDO: Every two weeks.
MS. DUGAN: Had you ever been paid for weeks of work prior to completing your work there?
CLARIZA LEBREDO: Yes.
MS. DUGAN: When that would happen, would it be because the Adelson family was going out of town or going on a vacation for a couple weeks?
CLARIZA LEBREDO: Right, they were going away, they were going on vacation, so we got paid before.
MS. DUGAN: About how often would that happen?
CLARIZA LEBREDO: Maybe once or twice a year.
MS. DUGAN: Okay, so just once or twice a year. And when that would happen, how many paychecks would you get at one time?
CLARIZA LEBREDO: Two.
MS. DUGAN: Two?
MS. DUGAN: All right. Would you ever get four, five, six paychecks in a row?
CLARIZA LEBREDO: No.
MS. DUGAN: Have you ever been aware of any Adelson Institute employee in the history of your employment there that has worked exclusively by phone or remotely?
CLARIZA LEBREDO: No.
MS. DUGAN: Did the Adelson Institute have a cleaning service at that time?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And was it a husband-and-wife team?
CLARIZA LEBREDO: Yes.
MS. DUGAN: And have you seen those people before?
CLARIZA LEBREDO: Yes. I know who they are. I knew who they were. Yes.
MS. DUGAN: Was Katherine Magbanua a part of that team?
CLARIZA LEBREDO: No.
MS. DUGAN: Those are all my questions. Thank you.
JUDGE EVERETT: Cross-examination.
MR. RASHBAUM: No questions, Your Honor.
JUDGE EVERETT: The witness may step down. Will she be recalled at any point?
MS. DUGAN: No, sir.
JUDGE EVERETT: Have a good day, ma'am.
