You said during direct examination that you played a role as a Latin King member; correct? Did you do any research to assist you in playing this role?

what I want to differentiate for the Court is it's our position that none of the calls should come in, however, I don't know if the Court is of a different position. Like, for example, I anticipate that the next phone call the State is going to want to play is a conversation between Donna Adelson and Charlie Adelson, and at this point, I can't find any hearsay exception.

My client was not privy to that conversation. She wasn't even made aware of it, and it doesn't fall within any hearsay exception. And it's also violating our right to confront witnesses against us, because now I cannot ask Donna or Charlie Adelson what they meant when they were doing that phone call.

JUDGE HANKINSON: All right. Let me be clear: In my -- both of you have said I've ruled on the wiretaps. That's not accurate in my estimation. There were two conversations that were brought up in the motion in limine. The State agreed that they were not going to play one of them. I overruled your objection as to hearsay on the other one. That was the meeting of Charlie Adelson where your client is present. I've overruled your objection on that one.

I have not ruled on any other wiretap as to admissibility or not admissibility, because I don't know anything about any of the rest of the wiretaps. So if there's some idea that I've ruled on them, I've not done so.

If it's a totally unrelated conversation between -- your client's not in, Mr. Garcia's not in, then in a general ruling, those are hearsay and I'm not going to admit them. But nobody has provided me with any wiretaps. I don't know anything about who did what when, so I've made no ruling. I guess at some point in time, somebody needs to give me some information on what's being proposed, but I'm making no ruling at this point in time.
